1. Acceptance of Terms

Welcome to our platform (the "Service"). By accessing, registering for, or using our website, APIs, automation scripts, and associated tools, you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately cease all use of our Service.

2. User Responsibilities & Assumption of Risk

IMPORTANT NOTICE: You assume all responsibility and liability for your use of the Service. The Service involves executing automation tasks. You acknowledge that automation carries inherent risks (including, but not limited to, account ban on third-party platforms, data corruption, or script failure).

You represent and warrant that your use of the Service complies with all applicable local, state, national, and international laws, regulations, and third-party terms of service (including, but not limited to, the terms of service of any social network, web platform, or database you automate). You agree that we are not responsible for any consequences arising from your scripts, parameters, uploads, or configuration inputs.

3. Prohibited Malicious Activity & Hacking

ZERO-TOLERANCE POLICY: Any attempt to bypass security controls, disrupt service availability, compromise data integrity, reverse engineer our software, or inject malicious code is strictly prohibited.

Without limiting the generality of the foregoing, you agree not to:

  • Gain or attempt to gain unauthorized access to our servers, databases, source code, network infrastructure, or user accounts.
  • Inject malware, worms, trojans, viruses, or execute script injections or SQL injection attacks.
  • Conduct vulnerability scanning, penetration testing, load testing, or scraping of the website and service without written authorization.
  • Initiate or participate in Distributed Denial of Service (DDoS) attacks or automated flooding mechanisms.
  • Engage in illegal access or manipulation under federal and state computer crime statutes.

4. Immediate Ban, Account Forfeiture & No Refunds

If we detect, in our sole and absolute discretion, that you have violated Section 3 (Prohibited Activity), attempted to hack the platform, performed malicious actions, or breached security systems, we reserve the right to:

  • Immediately and permanently ban your account, unique ID, API keys, and IP address.
  • Forfeit and wipe all balances, remaining credits, and top-ups associated with your account.
  • Refuse any past, current, or future refunds or chargeback requests. You agree that any forfeited funds represent liquidated damages for security response, investigation overhead, and system disruption.

Additionally, we reserve the right to report malicious actions to law enforcement authorities and seek damages in court.

5. Compliance with Applicable State and Federal Laws

This Service is operated in accordance with the laws of the United States. You agree that any hacking or unauthorized access violates state and federal laws, including:

  • The Computer Fraud and Abuse Act (CFAA) (18 U.S.C. ยง 1030): Accessing a protected computer without authorization or exceeding authorized access.
  • The California Comprehensive Computer Data Access and Fraud Act (California Penal Code Section 502): Knowingly and without permission accessing, altering, damaging, deleting, destroying, or otherwise using any computer, system, network, or data.
  • The California Consumer Privacy Act (CCPA): Any misuse or illegal collection of personal identifier information or breaching of other users' privacy data.

6. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT, MODULES, AND SCRIPTS PROVIDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW (INCLUDING CALIFORNIA CIVIL CODE), WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR FREE OF VIRUSES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Service, its parent company, subsidiaries, affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Governing Law & Dispute Resolution

These Terms and any action related thereto shall be governed by, and construed in accordance with, the laws of the State of California, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the state and federal courts located in the county of registration for our business in the State of California.

10. Modifications to Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. We will indicate the date of the latest update at the top of this page. Your continued use of the Service following any modifications constitutes acceptance of the new Terms.
